These Terms & Conditions explain the terms that apply when you use our website, purchase products or tickets from us, access digital products, make a donation or use other services available through our website.

About these Terms

By using our website or purchasing something through it, you agree to these Terms & Conditions where they are relevant to your use of the website.

Some Hope For Podencos activities have separate terms, policies or agreements. These include, where applicable:

  • adoptions, fostering and rehoming;

  • raffles, lotteries and competitions;

  • individual fundraising campaigns;

  • events;

  • our Refunds & Exchanges Policy; and

  • our Privacy & Cookies Policy.

Where specific terms are provided for a particular activity, those terms should be read alongside these Terms. If there is a conflict, the specific terms for that activity will take precedence.

Nothing in these Terms affects any statutory rights you have as a consumer.

Using our website

You may use our website for lawful purposes only.

You must not:

  • use the website in a way that breaks any applicable law;

  • knowingly provide false or misleading information;

  • impersonate another person;

  • introduce viruses, malware or other harmful material;

  • attempt to gain unauthorised access to our website, systems or data;

  • interfere with the operation or security of the website;

  • collect or scrape personal information from the website without a lawful basis; or

  • copy or commercially exploit our website content without permission where that content is protected by intellectual property rights.

We may restrict or suspend access to all or part of the website where reasonably necessary for security, maintenance, legal or operational reasons.

If you are under 18, you should only make purchases or donations with the involvement or permission of a parent or guardian where required. Some activities, including raffles, may have separate age requirements.

Information on our website

We take reasonable care to ensure that the information on our website is accurate and up to date. However, rescue work is continually changing and information may occasionally become outdated or require correction.

Information about dogs reflects what is known to us at the time it is published. A dog's health, behaviour, circumstances, location, availability or assessed needs may change as we receive new information or as the dog moves through rescue, foster or adoption.

A dog being shown as available on the website does not guarantee that the dog is still available or that an adoption application will be successful.

General information published on our website about dogs, health, behaviour, training or welfare is intended to provide guidance and information. Where appropriate, professional veterinary, behavioural or other specialist advice should be sought for an individual animal.

We may update, remove or correct website content at any time.

Adoption, fostering and rehoming

Submitting an adoption, foster, rescue or rehoming form does not create a contract with Hope For Podencos and does not guarantee that an application or proposed placement will proceed.

All adoption and foster applications are subject to our assessment process. Our responsibility is to consider the needs and welfare of the individual dog alongside the circumstances of the proposed home.

We may decide that a particular dog or placement is not suitable, even where an applicant otherwise meets our general criteria.

Where an adoption, foster or rehoming arrangement proceeds, it will be governed by the relevant agreement or contract provided by Hope For Podencos.

Our online shop

Products

We sell physical merchandise and may also offer digital products and other items through our website.

We make reasonable efforts to describe and display products accurately. Colours and appearance may vary slightly depending on the device or screen used, and handmade or printed items may have minor variations.

All products are subject to availability.

We may change or discontinue products or change prices for future orders at any time.

Placing an order

When you place an order, you are offering to purchase the products shown in your order.

Receiving an automated order confirmation or payment confirmation does not necessarily mean that we have accepted the order.

A contract is formed when we accept your order and either:

  • confirm that physical goods are being prepared or dispatched;

  • make a digital product available to you; or

  • otherwise confirm that the order has been accepted.

We may decline or cancel an order where reasonably necessary, including where:

  • an item is unavailable;

  • there has been an obvious pricing or description error;

  • payment cannot be authorised;

  • we reasonably suspect fraud or misuse; or

  • we cannot lawfully supply the product to the delivery location.

If we cancel an order after taking payment and no goods or services have been supplied, we will refund the relevant amount.

Prices and payment

The price payable is the price shown at checkout at the time you place your order, together with any applicable delivery charge or other charge clearly shown before payment.

If an obvious pricing error occurs, we may contact you to give you the option of proceeding at the correct price or cancelling the order.

Payments may be processed through third-party payment providers. Their own terms and privacy policies may also apply to their services.

Physical goods and delivery

We ship physical merchandise internationally where delivery is available through our website.

Delivery costs and available delivery options will be shown at checkout where applicable.

Any delivery times shown are estimates unless we expressly state otherwise.

We are not responsible for delays caused by circumstances outside our reasonable control, but we will take reasonable steps to help resolve delivery problems.

You are responsible for providing a complete and accurate delivery address. Please contact us as soon as possible if you notice an error.

For international deliveries, customs duties, import taxes or similar charges may be imposed by the destination country. Where these charges are not collected by us at checkout, they are the responsibility of the recipient.

Cancelling and returning physical goods

If you are a UK consumer purchasing goods online, you will normally have a legal right to change your mind and cancel your order from the time the contract is made until 14 days after you receive the goods, subject to any legal exceptions.

If you exercise this right, you then have a further 14 days to return the goods.

For a change-of-mind return, you are responsible for the cost of returning the goods to us unless we agree otherwise.

Where required by consumer law, we will refund the price paid for the goods together with the cost of our standard delivery option. Additional amounts paid for enhanced or premium delivery are not normally refundable beyond the cost of standard delivery.

You may handle goods to the extent reasonably necessary to establish their nature, characteristics and functioning. We may be entitled to make an appropriate deduction where goods have been handled beyond what would reasonably be permitted in a shop and their value has been reduced.

Customers outside the UK may have additional or different mandatory consumer rights under the laws that apply where they live. Nothing in these Terms is intended to remove those rights.

Faulty, damaged or incorrect goods

Your change-of-mind rights are separate from your rights where something is wrong with the goods.

Please contact us if an item:

  • is faulty;

  • arrives damaged;

  • is not as described; or

  • is not the item you ordered.

We will deal with the issue in accordance with your applicable consumer rights.

Where goods are faulty, damaged or incorrectly supplied, we will not require you to bear return costs where the law requires those costs to be met by us.

Nothing in our Refunds & Exchanges Policy limits your statutory rights.

Digital products

Some products may be supplied digitally rather than physically.

Before purchasing a digital product, you are responsible for checking any information provided about its format, compatibility or technical requirements.

Where a digital product is supplied immediately, you may be asked to expressly consent to receiving the digital content during the statutory cancellation period and to acknowledge that your right to cancel will be lost once supply begins.

Where that consent and acknowledgement are validly given, your statutory right to change your mind will end when supply of the digital content begins.

This does not affect your rights if digital content is faulty, not as described or does not otherwise meet applicable legal requirements.

Event tickets

We may sell tickets for fundraising events and other Hope For Podencos events through our website.

Details specific to an event, including its date, location, entry requirements and any event-specific conditions, will be shown on the relevant event page or ticket information.

Tickets for leisure events taking place on a specific date or during a specific period do not normally carry the same statutory 14-day change-of-mind cancellation right that applies to most physical goods bought online.

Any voluntary cancellation, transfer or refund arrangements offered by Hope For Podencos will be set out in the relevant event information or our Refunds & Exchanges Policy.

If we cancel an event and cannot provide the event purchased, we will refund the relevant ticket price where required. We are not responsible for separate travel, accommodation or other costs you incur in connection with an event except where liability cannot lawfully be excluded.

If an event is postponed, rescheduled or materially changed, we will explain the options available to ticket holders.

Donations

General donations

Donations to Hope For Podencos are charitable gifts and are not payments for goods or services.

Unless a donation is made to a fundraiser or appeal that expressly restricts how the money will be used, donations are unrestricted funds and may be used wherever Hope For Podencos considers they are most needed in furtherance of our charitable purposes.

This allows us to meet the costs involved in rescuing, caring for and rehoming dogs and carrying out our wider charitable work.

Donations made in error

Charitable donations do not generally carry the same cancellation rights as purchases from our shop.

If you believe that:

  • you made a donation accidentally;

  • you entered the wrong amount;

  • a payment was duplicated; or

  • a payment was made without your authority,

please contact us as soon as possible.

We will consider requests for refunds taking account of the circumstances and our legal responsibilities as a charity.

Fundraisers for a specific dog or purpose

From time to time we may run a fundraising appeal for a particular dog, veterinary treatment, rescue or other specified purpose.

Where we expressly state that donations are being raised for a particular dog or purpose, those donations will be treated as restricted to the purpose described in that appeal.

We will use those funds for the stated purpose.

If circumstances change, the purpose can no longer be achieved or more money is raised than is required for the stated purpose, we will deal with the funds in accordance with the wording of the appeal and our obligations under charity law.

Where an appeal expressly includes a secondary or alternative purpose, funds may also be used for that stated purpose in the circumstances described by the appeal.

Dog sponsorships and recurring sponsorship donations

Our dog sponsorship programme allows supporters to associate their regular support with a named Hope For Podencos dog.

Sponsorship payments are not restricted exclusively to the named dog. They are donations to Hope For Podencos and are used to support the care, rescue and welfare of dogs across our work.

The named dog is the focus of the sponsorship relationship, but sponsorship does not create a separate fund reserved solely for that dog.

Recurring sponsorship payments will continue at the frequency selected until they are cancelled.

If your sponsored dog is adopted, dies, leaves our care or otherwise ceases to be available for sponsorship, we will contact you as soon as reasonably practicable and give you the option to:

  • end your recurring sponsorship; or

  • move your sponsorship to another dog.

You may also ask us to cancel or change your recurring sponsorship at any time by contacting us.

Cancelling a recurring sponsorship stops future payments. It does not normally create a right to a refund of donations already made, although we will investigate payment errors or unauthorised transactions.

Gift Aid

Where a donation is eligible for Gift Aid and you provide a valid Gift Aid declaration, Hope For Podencos may claim Gift Aid on that donation in accordance with HMRC requirements.

By making a Gift Aid declaration, you are confirming the information required by that declaration, including the relevant tax requirements.

You are responsible for notifying us if your circumstances change and your declaration is no longer valid.

Not every payment made to Hope For Podencos will necessarily qualify for Gift Aid. Eligibility will be determined in accordance with HMRC rules.

Raffles, lotteries and competitions

Raffles, lotteries and similar fundraising activities are governed by their own specific terms and eligibility requirements.

Our raffle Terms & Conditions will apply to raffle entries and should be read before purchasing a ticket.

A raffle ticket is not treated as an ordinary shop purchase and the cancellation and returns provisions applying to merchandise do not apply to raffle entries unless the applicable raffle terms or law provide otherwise.

Content you send to us

Information you provide through adoption, foster, rescue, rehoming, contact or other forms will be handled in accordance with our Privacy & Cookies Policy.

Submitting personal information to us does not give Hope For Podencos a general right to publish that information.

If you voluntarily provide photographs, videos, testimonials, reviews, stories or other material specifically for publication or promotional use, you confirm that you have the right to provide that material and to give us permission to use it for the purpose for which it was supplied.

Where appropriate, we may edit material for length, formatting or clarity without materially changing its meaning.

If third-party rights are involved, including the rights of a photographer or another identifiable person, you must have the necessary permission before providing the material to us for publication.

Intellectual property

Unless otherwise stated, the website and the material created by or for Hope For Podencos, including our branding, written content, graphics and other original materials, are protected by intellectual property rights.

Some photographs, artwork and other materials appearing on the website belong to third parties and are used by Hope For Podencos with permission.

You may view and use website content for your own personal, non-commercial purposes.

You must not reproduce, sell, commercially exploit, alter or distribute protected HFP content without our permission or the permission of the relevant rights holder, except where the law permits you to do so.

Third-party websites and services

Our website may contain links to websites, services or resources operated by third parties.

We do not control third-party websites and are not responsible for their content, availability or practices.

Where you choose to use a third-party service, including a payment or external booking service, that provider's own terms and privacy information may also apply.

A link from our website does not necessarily mean that Hope For Podencos endorses every aspect of the third party's website, products, services or views.

Website availability

We aim to keep our website available and operating correctly, but we cannot guarantee uninterrupted or error-free access.

We may temporarily suspend, withdraw, update or change parts of the website for maintenance, security, technical or operational reasons.

We are not responsible for temporary loss of access caused by circumstances outside our reasonable control.

Our responsibility to you

Nothing in these Terms excludes or limits liability where it would be unlawful for us to do so, including liability for:

  • death or personal injury caused by our negligence;

  • fraud or fraudulent misrepresentation; or

  • any other liability or consumer right that cannot lawfully be excluded or limited.

If we fail to comply with these Terms, we are responsible for loss or damage that is a foreseeable result of our breach or failure to use reasonable care and skill.

We are not responsible for loss or damage that was not reasonably foreseeable.

We are also not responsible for delays or failures caused by events outside our reasonable control, although this does not affect any rights you may have to receive a refund or other remedy under consumer law.

Nothing in these Terms limits your statutory consumer rights.

How we collect, use, store and protect personal information is explained in our Privacy & Cookies Policy.

Our use of cookies and similar technologies is also explained in that policy and through the cookie controls available on our website.

Changes to these Terms

We may update these Terms & Conditions from time to time, including to reflect changes in our activities, website, legal obligations or working practices.

The current version will be published on this page and identified by its “Last updated” date.

Changes will normally apply to future use of the website and future transactions.

Changing these Terms will not retrospectively remove rights that you have already acquired under an existing purchase, donation arrangement or other agreement.

Governing law and disputes

These Terms are governed by the laws of England and Wales.

If you are a consumer living elsewhere in the UK or another country, you may also benefit from mandatory consumer protections that apply where you live. Nothing in these Terms is intended to remove rights that cannot legally be excluded.
